Introduction

Welcome to My OPD Online (“we”, “our” and “us”)! Such Terms of Service (“Term” and “Term of Service”) control the use of My OPD Online’s website located at myopdonline.com (“Service” together or individually). Our Privacy Policy also regulates your use of our Service, and outlines how we gather, secure and reveal information arising from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy(“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them. These Words are applicable to all the visitors, customers and those wishing to access or use the facility.

Healthcare Services

All of the Treating Providers who deliver Services through My OPD Online are independent professionals solely responsible for the services each provides to you. My OPD Online does not practice medicine or any other licensed profession, and does not interfere with the practice of medicine or any other licensed profession by Treating Providers, each of whom is responsible for his or her services and agreement with the requirements applicable to his or her profession and license. Neither My OPD Online nor any third parties who promote the Services or provide you with a link to the Service shall be liable for any professional advice you find from a Treating Provider via the Services.

Content

Content initiate on or through this Service are the property of My OPD Online or used with permission. You may not allocate, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for individual gain, without express advance written permission from us.

Informed Consent

My OPD Online is the delivery of health care services using interactive audio and video technology, where the patient and the health care professional are not in the same physical location. During your My OPD Online session with a Treating Provider, details of your health history and personal health information may be discussed with you through the use of interactive video, audio and other telecommunications technology, and your Treating Provider may perform a physical examination through these technologies.

Prohibited Uses

You may use Service only for lawful dedications and in accordance with Terms. You agree not to use Service:

  • In somewhat way that violates any appropriate national or international law or rule.
  • For the purpose of exploiting, damaging, or struggling to exploit or harm minors in any way by exposing them to unsuitable content or otherwise.
  • In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
  • To engage in any other manner that restricts or inhibits anyone’s use or enjoyment of Service, or which, as determined by us, may harm or offend Concern or users of Service or expose them to liability

No Use By Teen-agers

Facility is intended only for access and use by persons at least eighteen (18) years old. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age and with the full expert, right, and capacity to enter into this contract and stand by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and custom of Service.

Accounts

Once you create an account with us, you assurance that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Mistaken, incomplete, or obsolete information may result in the immediate termination of your account on Service.

You are responsible for keeping the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all actions or actions that arise under your account and/or password, whether your password is with our Service or a third-party service. You must inform us directly upon becoming aware of any breach of security or unauthorized use of your account

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or symbol that is subject to any rights of additional person or entity other than you, without appropriate authorization. You may not use as a username any name that is attacking, vulgar or indecent.

We standby the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole pleasure.

Fees And Purchase Terms

You agree to pay all fees or charges to your Account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. By providing My OPD Online with your credit card number or PayPal account and associated payment information, you agree that My OPD Online  is authorized to immediately invoice your account for all fees and charges due and payable to My OPD Online  here under and that no additional notice or consent is required. If your health plan, employer or agency has arranged with My OPD Online to pay the fee or any portion of the fee, or if the fee is pursuant to some other arrangement with My OPD Online , that fee adjustment will be reflected in the fee that you are ultimately charged.

Please check with your employer, health plan or agency to determine if any Services will be reimbursed. If you do not have insurance coverage for Services, or if your coverage is denied, you acknowledge and agree that you shall be personally responsible for all incurred expenses. My OPD Online offers no guarantee that you shall receive any such reimbursement. My OPD Online reserves the right to modify or implement a new pricing structure at any time prior to billing you for your initial payment or for future payments due pursuant to these Terms of Use. You understand and agree that for Services provided on an appointment basis, you will be responsible for a missed appointment fee equal to the fees you and your insurer or other pay or would have paid for the scheduled services if you do not cancel a scheduled appointment at least 24 hours in advance.

Intellectual Property

Facility and its original content (excluding Content provided by users), features and functionality are and will continue the exclusive stuff of My OPD Online and its licensors. Service is secure by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without the prior written consent of My OPD Online.

Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

Error Reporting and Feedback

You may provide us either directly at [email protected] or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Company and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose..

The Sites are provided “as is” and without guarantees of any kind, either express or implied. To the completest extent permissible pursuant to applicable law, My OPD Online disclaims all pledges, express or indirect, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. My OPD Online does not warrant that the Sites will be uninterrupted or error-free, that defects will be modified or that the Sites or the server that creates it available are free of viruses or other injurious components.

Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
